Federal CFPA Case Peters v. Checkout.com, No. 2026-CFP-00004: Discovery Ongoing, Response Due August 27, 2026

COVINGTON, LA — August 17, 2026 — A federal administrative proceeding involving Peters v. Checkout.com, Case No. 2026-CFP-00004, remains in discovery following an August 10, 2026 order from the U.S. Department of Labor’s Office of Administrative Law Judges.

Administrative Law Judge Heather C. Leslie granted Checkout.com a fourteen-day extension to file its Complaint Response, making the new deadline August 27, 2026.

According to the order, James Peters filed a complaint with the Occupational Safety and Health Administration on or about January 28, 2026, alleging violations of the employee protection provisions of the Consumer Financial Protection Act, 12 U.S.C. § 5567, and the implementing regulations at 29 C.F.R. Part 1985. OSHA dismissed the complaint by letter dated February 25, 2026. Peters appealed, and the Office of Administrative Law Judges docketed the case on March 24, 2026.

The case was assigned to Judge Leslie on July 7, 2026. Peters filed his Pleading Complaint on July 30, 2026. Checkout.com moved on August 7 for additional time to file its Complaint Response and indicated that it intends to challenge Peters’s standing under 12 U.S.C. § 5567.

Peters opposed the extension. In addressing his concern that additional time could delay or impede discovery, Judge Leslie wrote: “Discovery will continue and is ongoing.”

The order describes the anticipated standing challenge as a threshold issue and states that Peters will be afforded time to oppose the challenge.

Judge Leslie concluded that the fourteen-day extension would not unduly delay the case or prejudice Peters. Checkout.com’s Complaint Response is due on or before August 27, 2026.
